Mr. Sandy Guo, a senior partner at Shanghai Horizon Law Firm, is an external tutor at Northwest University of Political Science and Law and a visiting professor at Shanghai Maritime University. Lawyer Guo's areas of expertise include maritime and admiralty law, insurance (reinsurance), banking and finance, corporate mergers and acquisitions, freight logistics, and real estate. Litigation Representative Performance

1. Lawyer Guo has long served as a reinsurance legal consultant for a large insurance company, representing multiple reinsurance contract disputes.
2. Since December 2015, Lawyer Guo has been serving as a legal consultant for litigation property preservation liability insurance risk control for a large insurance company, reviewing over a thousand cases exceeding the authority of its branch compan ies each year, and has represented dozens of cases involving disputes over compensation for damage caused by litigation property preservation.
3. Represented an insurance company in a maritime insurance contract dispute with a shipping company, with the shipping company claiming RMB 56.93 million and interest. The judgment amount was RMB 8.44 million with a reduction ratio of 86%. The case went through the first trial at Ningbo Maritime Court, the second trial at Zhejiang Provincial Higher People's Court, and the retrial at the Supreme People's Court, lasting more than five years. The case is a landmark case for general average in domestic coastal cargo transportation. At the invitation of China Council for the Promotion of International Trade, Lawyer Guo shared the case at the C CPIT ’ s Law Lecture on April 2, 2024.
4. Represented an insurance company in a shipbuilding insurance contract dispute with a ship yard, with the ship yard claiming RMB 54.24 million and interest. The court's judgment amount was RMB 3.03 million, with a reduction ratio of up to 95%.
5. Represented an insurance company in an insurance contract dispute with a foreign company due to cargo damage during transportation by China-Europe Railway Express. The insured person claimed more than RMB 37 million for the damage caused by the transportation of goods via the China-Europe Railway Express. After taking the case, Lawyer Guo and his colleague overcame the unclear insurance terms and unclear communication process, and after unremitting efforts to collect evidence, ultimately achieved a complete victory.
6. Provided the whole course legal services for an insurance company and a communication service company in a warehousing goods fire case, involving insurance claims, insurance contract disputes, and recovery, with the loss amount reaching more than RMB 80 million, and the recovery effect was good.
7. Represented the shipowner of "Enji 1" in a collision dispute with "Xiang Zhangjiajie 3003", which went through the first trial at Xiamen Maritime Court, the second trial at Fujian Provincial Higher People's Court, and the retrial at the Supreme People's Court. (2018) Supreme Court Civil Retrial No. 453 was selected as one of the top ten typical maritime trials of the year by the Supreme People's Court in 2018.
8. Represented a Shanghai ecological environment technology company in a construction contract dispute with a listed environmental group, overcoming unfavorable factors such as unfavorable contract terms and local protection, and the claims were fully supported, successfully maintaining the interests of the client.
9. Represented a Shanghai branch of a domestic bank in a domestic letter of credit negotiation dispute with a Xiangtan branch of antoher domestic bank. The case involved a basic contract involving a letter of credit fraud, and the defendant raised jurisdiction objections, and according to “ the principal of criminal procedure prior to civil procedure”, the civil procedure should be suspended for trial, and other reasons. After collecting similar case judgments, the court was persuaded to accept that the dispute between the letter of credit applicant and the beneficiary, and the dispute between the letter of credit negotiation bank and the letter of credit issuing bank are two different natures, different legal relationships, and different litigation subjects, each with its own independent litigation request and substantive rights, and the claims were fully supported.
10. Represented a large pharmaceutical company in Shanghai in a corporate loan dispute with a pharmaceutical company in Gaoyou, with the case involving an amount of RMB 46 million. Overcoming major adverse factors such as severe local protection and the legal representative of the client being sentenced for a crime, the loan was recovered after ten years of effort.

Arbitration Representative Performance

1. Represented a Shaoxing textile printing and dyeing Company. in an arbitration case of a sales contract dispute with a Taiwan industrial technology Company, and the arbitration request was fully supported.
2. In the arbitration case of a landscape engineering project contract dispute between a Nantong g arden l andscape company and a Zhangjiagang resort Company., provided legal services for the Zhangjiagang resort Company., and reached an arbitration settlement with a reduction ratio of 67%.
3. In the arbitration case of an investment and repurchase dispute between a Shanghai equity investment fund (limited partnership) and Mr. Wu and others, provided legal services for the Shanghai equity investment fund, and the arbitration request was fully supported.
4. In the arbitration case of a fund contract dispute between a Xinyu investment management center (limited partnership) and a holding group company, provided legal services for the holding group company, and the reduction ratio was as high as 98.5%.
5. In the case of a general average caused by the breakdown in the main engine of a foreign ship, provided whole course legal services for the insurer of the cargo carried by the foreign ship, including choosing the adjuster, commenting on the GA adjustment report, and arbitration in the UK. The initial effect is good, and the arbitration case in the UK is still in progress.
